The Protection Of Personal Information Bill No B9
The Protection Of Personal Information Bill No B9 – 2009 will undoubtedly have a significant impact on all hospitality establishments and corporate offices. It will govern the manner in which all personal information (clients/employees/debtors etc.) is gathered, processed, retained and secured. In addition, the Bill deals with the processing of personal information for the purpose of direct marketing by means of automatic calling machines, facsimile machines, SMSs or electronic mail.

MINISTER OF JUSTICE AND CONSTITUTIONAL DEVELOPMENTThe Minister of Justice and Constitutional Development intends introducing the Protection of Personal Information Bill, 2009, in the National Assembly shortly. The Protection of Personal Information Bill, 2009, is intended to promote the protection of personal information processed by public and private bodies; to introduce information protection principles so as to establish minimum requirements for the processing of personal information; to provide for the establishment of an Information Protection Regulator; to provide for the issuing of codes of conduct; to provide for the rights of persons regarding unsolicited electronic communications and automated decision making; to regulate the flow of personal information across the borders of the Republic; and to provide for matters connected therewith.
Comment - The Bill will now follow the usual parliamentary process and will in all probability be put out for public comment and submission by the Portfolio Committee at some time in the near future.
